Introduction

Victory Waterpolo provides online class registration services to facilitate your enrollment and registration of yourself or other family member (collectively, ’you’ or any applicable derivation thereof) for the classes.

By accessing www.victorywaterpolo.com (hereinafter the ’Site’), you agree to the terms and conditions outlined in these Terms & Conditions (hereinafter ’T&Cs’) with respect to the Site and you are consenting to have your personal data transferred to and processed in the United States. These T&Cs constitute the entire and only agreement between Victory Waterpolo and you for use of the Site.

We may change or modify these T&Cs at any time and such changes or modifications will take effect immediately upon posting to the Site. Your continued use of the Site after any change or modification constitutes your acceptance of the new T&Cs.
Eligibility and parental/guardian responsibility

The Site is available only to users who can form legally binding contracts under applicable law. Any registration by anyone under 18 is unauthorized, unlicensed and in violation of these T&Cs. By registering to the Site, you represent and warrant that you are 18 years of age or older and that you are fully able to enter into and to abide by all of the terms and conditions of these T&Cs.

As a parent/guardian registering on behalf of your minor child, you agree to accept full responsibility, financial, medical or otherwise, for your child’s actions. If your child is dismissed from a class for improper conduct, you understand that we will not refund any registration or enrollment fees.

Limitation of liability:

Under no circumstances shall Victory Waterpolo be liable to you or any third party for any direct, indirect, incidental, special, reliance, consequential or punitive damages, including lost profits, cost of cover, or lost data that arise in whole or in part from the use of, or the inability to use, the Site or the services or functions of the Site or arising out of your access to, or inability to access, the Site or your reliance upon, the Site or the services, content or materials in, or functions of, the site, provision of, or failure to provide services, or information, whether or not we have been advised of the possibility of such damages, and on any theory of liability (including negligence). Applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. If you are dissatisfied with the Site or the services, your sole and exclusive remedy shall be to discontinue use of the Site.

By registering to this Site or elrolling to a class, you release, waive, discharge, and covenant not to sue Victory Waterpolo, its staff (hereinafter referred to as ’releasees’) from all liability to you for any loss or damage, and any claim or demands, therefore on account of injury to you or your property, or resulting in death, whether caused by the negligence of the releasees or otherwise while you are in any Victory Waterpolo related premises or facilities, or using any Victory Waterpolo related equipment or participating in any program affiliated with Victory Waterpolo.

By registering to this Site or elrolling to a class, you assume full responsibility for and risk of bodily injury, death or property damage to you, due to the negligence of releasees or otherwise while in, about, or on any premises associated with Victory Waterpolo and/or while using any premises, facilities or equipment or participating in any program affiliated with Victory Waterpolo. You willingly and voluntarily accept and assume all such risk.

If you as a parent/guardian cannot be reached in case of emergency, we deem your authorization to Victory Waterpolo and its staff to obtain whatever medical treatment deemed necessary for the welfare of your child. By registering to this Site or elrolling to a class, you release, indemnify and hold harmless Victory Waterpolo, its staff from any and all claims arising out of injury to your child.

By registering to this Site or elrolling to a class, you grant Victory Waterpolo and its staff, the absolute and irrevocable right and permission to photograph and record you in connection with your participation in the events, activities and programs offered by Victory Waterpolo. You agree that Victory Waterpolo owns all right, title and interest in and to the material. By registering to this Site or elrolling to a class, you, without reservation, assign all of your rights (including, copyright) in and to the material.

Payment

All fees are due and payable at the time of enrollment.

Cancellation: For cancellations to be eligible for a refund, cancellation requests must be received via e-mail no later than 2 days before the training.

Collection, use and disclosure of personal data

The collection, use and disclosure of personal data provided to Victory Waterpolo through this Site is governed by our Privacy Policy.
Applicable law

These T&Cs are governed by and construed in accordance with the internal law of the State of California without regard to its principles of conflicts of laws. Any action arising out of or relating to these T&Cs shall be filed only in the state or federal courts located in the County of San Jose in the State of California, and you hereby consent and submit to the exclusive personal jurisdiction of such courts for the purpose of litigating any such action.

Any dispute, controversy, proceeding, or claim arising out of or in connection with or relating to these T&Cs, or any of Victory Waterpolo policies, whether in contract, tort, common or statutory law, equity or otherwise shall be first attempted to be resolved in an amicable manner.
